Additional Terms for Fluent Connect (v1.0) [superseded]

Essential knowledgeThe Additional Terms for Fluent Connect apply to and govern use of Fluent Connect and all Hosted Connectors (including Connect Inventory) and are incorporated into the MSA entered into between the Client and Fluent Commerce.   
  • Whenever Hosted Connectors (including any Connected Inventory) are included in an Order Form, the Additional Terms for Fluent Connect apply in addition to the MSA.  
  • Each Hosted Connector is defined by reference to a Connector Specification and connects the Fluent Order Management platform with the applicable Target System.
  • Client is responsible for Target System subscription and connectivity, including communicating all changes relating to Target System to Fluent Commerce.

Additional Terms for Fluent Connect (v1.1)

EU Data Act – Information and Disclosures (v1.0)

Essential knowledgeOn this page you will find information about how Fluent Commerce addresses the mandatory contractual, technical and disclosure requirements relating to switching and interoperability under the EU Data Act.
  • EU Data Act mandated contractual requirements are set out in Fluent Commerce's Additional Terms for the EU Data Act.
  • Data can be exported using Fluent Order Management Platform APIs and is further described in Fluent Commerce's Switch Process.

Additional Terms for EU Data Act (v1.0)

Essential knowledgeThe EU Data Act Addendum only applies to Clients that are from an EU country. The Addendum sets out the rights and obligations of both the Client and Fluent Commerce to reflect, and in compliance with, the switching requirements of the EU Data Act.    
  • Contains contractual clauses relating to switching and interoperability rights and obligations as required y the EU Data Act.
  • Explains the switching process, exportable data and timeframes.
  • Describes what happens if switching results in early termination.

Security Policy (v2.0)

Essential knowledgeDescription of the technical and organisational measures implemented by the Fluent Commerce (including any relevant certifications) to ensure an appropriate level of security, taking into account the nature, scope, context and purpose of the processing, and the risks for the rights and freedoms of natural persons.
  • Data Encryption: Both in-transit and at-rest data are secured using advanced encryption methods, including TLS 1.2+ for data in transit and AES-256 for data at rest.
  • System Resilience: Infrastructure spans multiple fault-tolerant, independent availability zones within each geographical region, which are physically separated from one another.
  • Access Control: Access to data is strictly controlled through least privilege access principles, strong password policies, and Multi-Factor Authentication.
  • Incident Response: Fluent Commerce has measures in place for data restoration and system recovery in the event of a physical or technical incident.

Data Privacy Addendum (v1.1)

Essential knowledgeThis Data Privacy Addendum (DPA) details the data protection commitments and obligations of Fluent Commerce in relation to its Fluent Order Management cloud-based platform and services. Readers will find detailed information on the processing, transfer, and security of personal data by Fluent Commerce as data processor, and serves as a guide for clients to understand how their personal data is managed and protected.
  • The Data Privacy Addendum details Fluent Commerce's obligations in line with applicable data protection laws as data processor when processing personal data as data processor in context of its Clients' use of the Fluent Order Management Platform and Services. 
  • Clients maintain control as data controllers, while Fluent Commerce acts as a data processor, adhering to the Client's documented instructions for data processing.
  • Sub-processors may be engaged by Fluent Commerce with prior notification to the Client complying with applicable data protection laws.
  • Transfer of personal data across borders is governed by Standard Contractual Clauses to safeguard data in accordance with GDPR and other applicable data protection laws.

Essential knowledgeFluent Connect provides Hosted Connectors for integration between Fluent Order Management and external systems such as marketplaces, commerce platforms, payment providers, service platforms, and inventory distribution services. This approach simplifies integrations, reduces delivery timelines, and enables reliable connectivity across platforms.
  • Enables connectivity between Fluent Order Management and external systems (marketplaces, commerce, payments, service platforms, inventory).
  • Hosted connectors simplify operations but are not customer-modifiable
  • Includes specialized Connected Inventory hosted connectors for near real-time inventory updates to downstream platforms.
